Divorce

There are three types of divorce in Mississippi:

  • Irreconcilable Differences—Agreed by both parties
Most divorces are based on irreconcilable differences—no establishment of fault for the divorce is required. The couple agrees that their marriage cannot be fixed and that they should divorce. This is called a divorce based on irreconcilable differences, or a no-fault divorce. The couple must agree on all terms for this to work.
  • Irreconcilable Differences—Submitted to a judge when both parties do not agree
If the couple agrees to a divorce, but cannot agree to all the terms, the disputed terms may be submitted to a judge. Both spouses must agree to submit the disputed terms to the judge who renders a binding decision.
  • Fault Grounds—Guilt of one spouse must be proven in court

In a fault grounds divorce, one spouse sues the other for divorce based on a list of reasons recognized under Mississippi law for fault, such as:

  • Habitually cruel treatment
  • Drunkenness
  • Drug use
  • Adultery
  • Desertion
  • And others.

A judge oversees the divorce trial. The lawyer must prove guilt, based on fault grounds.  The judge determines the outcome, unless the couple settles before the trial finishes.
